WARRANTY TERMS FOR GARDEN TOOLS (PRUNERS, SHEARS, TROWEL, FORKS, CULTIVATOR)
1. "GERLACH" Joint Stock Company, based in Drzewica (26-340) at ul. Braci Kobylańskich 41 (hereafter referred to as Gerlach SA), hereby grants a warranty for the offered garden tools.
2. In case of a positive resolution of a complaint, within 21 days from the date the defective product is delivered by the distributor to the sales point or to the address indicated in point 1 above, Gerlach SA will rectify the defects and supply the distributor with defect-free products. If the defects cannot be removed, the customer may request a replacement of the product with a new one.
3. This warranty is granted solely for the use of the product according to its intended purpose, provided that the manufacturer's recommendations, especially in terms of use and maintenance, are followed. Furthermore, neither the purchaser nor any other unauthorized person by Gerlach S.A. has attempted to repair the device themselves, and only original spare and wear parts were used for the device's service.
4. The warranty does not cover damages resulting from improper use not in accordance with the instruction manual. The warranty also does not cover mechanical damages such as: normal wear and tear (e.g., scratches, dents, abrasions);
any changes in the external appearance of the product if such changes do not affect the product's functionality;
improper use, careless handling, negligence, or in cases of, e.g., impact, dropping, or compressing the product;
use of the product in a manner contrary to its intended or recommended use;
extreme temperatures (including heat, flames, or temperatures maintained for an extended period above +50 or below -30 degrees Celsius);
non-compliance with proper maintenance,
improper or insufficient storage of the product or care for it (including rusting or discoloration);
use of inappropriate cleaning methods or agents, including acids, solvents, or other aggressive substances;
exposure of the product to particularly aggressive and corrosion-promoting environments (for example, marine or industrial environments or leaving the product in continuous contact with water, chemicals, ash, cement, or dust).
5. The warranty is granted to the purchaser of the garden tools, provided that a proof of purchase of the warranted product along with the warranty card containing the warranty terms is presented at the sales point or at the headquarters of Gerlach SA along with the claimed product.
6. The warranty is valid within the territory of the European Union.
7. The warranty does not exclude, limit, or suspend the buyer's rights arising from the statutory warranty for defects of the sold item.
This manufacturer's warranty is limited to the repair of the product under the conditions described above. The manufacturer's warranty does not entitle the user to other claims against Gerlach S.A. as the manufacturer, such as claims for damages. This manufacturer's warranty does not limit statutory and contractual rights and claims of the buyer against the seller.
